Der praktisch bedeutsamste Fall der personenbedingten Kündigung ist die Kündigung wegen Krankheit. Zwar kann die Krankheit alleine eine Kündigung niemals rechtfertigen, jedoch ist sie auch kein Kündigungshindernis. Für den Arbeitnehmer treten neben der Belastung der Erkrankung noch die Gefahr des Verlustes der beruflichen Existenz auf, denn es kann auch während der bestehenden Arbeitsunfähigkeit eine Kündigung wegen Krankheit ausgesprochen werden. Die Rechtsprechung unterscheidet vier Fallgruppen der krankheitsbedingten Kündigung, deren Besonderheiten in der vorliegenden Arbeit anhand einiger Praxisfälle beleuchtet werden. Die krankheitsbedingte Kündigung erfasst alle Fallgestaltungen, bei denen die Krankheit und die daraus folgende Arbeitsunfähigkeit des Arbeitnehmers den Arbeitgeber zum Ausspruch einer Kündigung veranlassen. Die rechtlichen Probleme, die sich in diesem Zusammenhang ergeben, sind vielfach nicht gesetzlich geregelt, sondern werden im Wesentlichen der Rechtsprechung überlassen. Daher soll der Schwerpunkt dieser Arbeit auf die Darstellung der zahlreichen gerichtlichen Entscheidungen gelegt werden. Auch wenn die Rechtsprechung in den letzten Jahren einige Grundsätze herausgearbeitet hat, so wird deutlich, dass trotzdem manches widersprüchlich erscheint. Es wird immer wieder betont, dass jede Wertung der einzelnen Gesichtspunkte, die im Rahmen der krankheitsbedingten Kündigung geprüft werden müssen, einzelfallabhängig ist und festgelegte Grenzwerte, die eine Kündigung rechtfertigen, nicht existieren. Im Hauptteil der Arbeit werden die vier von der Rechtsprechung unterschiedenen Fallgruppen der Krankheitsarten, die jeweils einen Kündigungsgrund darstellen können, verdeutlicht. Zu Beginn wird auf den allgemeinen Begriff der Kündigung eingegangen und darlegt, welche Kündigungsarten existieren.
