November 2006 hat die Europäische Kommission ein Grünbuch für ein moderneres Arbeitsrecht vorgelegt. Dessen Zweck lag nach Meinung der Brüsseler Behörde darin, eine öffentliche Debatte darüber einzuleiten, "wie mit Hilfe des Arbeitsrechts Fortschritte bei der "Flexicurity"-Agenda erzielt werden können und damit das Entstehen eines gerechteren, reaktionsfähigeren und integrativeren Arbeitsmarktes gefördert werden kann, der dazu beiträgt, Europa wettbewerbsfähiger zu machen". "Flexicurity" ist dabei als ein Ansatz zu verstehen, der darauf abzielt das Spannungsverhältnis zwischen möglichst flexibler Gestaltung der Arbeitsverhältnisse und größtmöglicher Sicherheit für die Beschäftigten aufzulösen. Bereits kurz nach dessen Veröffentlichung wurde das Grünbuch teils heftig kritisiert. Insbesondere wurde der Kommission vorgeworfen eine schleichende Kompetenzverlagerung auf die europäische Ebene voranzutreiben bzw. gar die Schaffung eines einheitlichen europäischen Arbeitsvertragsgesetzbuchs zu erwägen. Formulierungen wie "Weiterentwicklung des Arbeitsrechts", "Notwendigkeit [...] die arbeitsrechtlichen Vorschriften anzupassen", bzw. die Frage nach der Erforderlichkeit eines "Grundstocks an Vorschriften" ließen Befürchtungen aufkommen, die Kommission erwäge Legislativvorschläge mit dem Ziel eines vereinheitlichten europäischen Arbeitsrechts. Zwar konnte die Kommission ihre schärfsten Kritiker mittlerweile beruhigen - in der Folgemitteilung zum Grünbuch heißt es, dieses sei von Anfang an nicht als "Grundlage für die Konzeption legislativer Maßnahmen" gedacht gewesen - die Diskussion um die aufgeworfenen Fragestellungen hält jedoch an. Insofern ist es mit dem Grünbuch zumindest gelungen Denkanstösse zu liefern und damit die Debatte um die Zukunft des Arbeitsrechts in Europa neu in Gan
