Nach einem Urteil des Landesarbeitsgerichts Hamm vom 04.11.2010 könne der behauptete Verzehr im vorliegenden Fall keinen wichtigen Grund für die fristlose Kündigung darstellen. Dabei seien insbesondere die 19-jährige Betriebszugehörigkeit und der Umstand, dass der Kläger nach den Tarifverträgen des öffentlichen Dienstes nur noch außerordentlich kündbar ist, zu berücksichtigen LAG Hamm, Urteil vom 04.11.2010 - 8 Sa 711/10. Es gibt keinen absoluten Kündigungsgrund "Diebstahl". Den gab es nie, auch wenn ältere Entscheidungen dies in ihrem Duktus zuweilen suggerierten. Insoweit kann die Entscheidung verstanden werden als eine Mahnung zur Ehrlichkeit an beide Seiten: Der Arbeitnehmer darf nicht stehlen, sonst riskiert er seinen Arbeitsplatz; aber der Arbeitgeber darf auch nicht einen Vorwand zur Kündigung aus ganz anderen Gründen suchen - und den Diebstahl zum willkommenen Anlass nehmen, ein Arbeitsverhältnis zu beenden, das aus ganz anderen Gründen zerrüttet ist, Thüsing, Editorial Heft 46/2010: Emmely - Das verkannte Wesen? Problematisch sind freilich die ersten Reaktionen der Instanzgerichte. Das LAG Berlin-Brandenburg wertet den Betrug über 160 Euro als nicht so gewichtig, dass eine außerordentliche Kündigung möglich sein soll, Urt. v. 16. 9. 2010 - 2 Sa 509/10, BeckRS 2010, 73000, das ArbG Frankfurt a. M. die unerlaubte Privatnutzung des Telefons in Höhe von mehr als 2500 Euro (Urt. v. 24. 9. 2010 - 24 Ca 1697/10). Das sind andere Dimensionen, und wer solch forsche Judikate in die Welt setzt, der kann sich nicht auf Emmely berufen.
