Abstract: Abstract of thesis entitled Communicative Planning for Sustainable Development: A Coasian Hong Kong Study on Planning by Contract in Action Submitted by Hung Wing Yee, Connie for the degree of Doctor of Philosophy at the University of Hong Kong in September 2007 This study uses statistical techniques to apply the Coase Theorem (Coase 1960) to examine the outcome of a major planning reforms in Hong Kong to promote communicative planning for sustainable development in an institutional setting of planning by contract. Different institutional arrangements involve different transaction costs and resource allocation implications, as these arrangements involve different parties and ways of property rights delineation. According to the corollary of the Coase Theorem (Lai 1994a; Lai and Hung 2008), a change in institutional arrangement leads to a change in transaction costs and the pattern of resource allocation. The amendment to the Town Planning Ordinance (Cap 131, Law of Hong Kong) on 10 June 2005 (the legal amendment), which was a major change in the institutional arrangement of planning, can be considered an attempt to promote "communicative planning for sustainable development" because the Planning Department has stressed the importance of transparency, as well as public and government communication in the report st "Sustainable Development for the 21 Century" (Hong Kong (China). IPlanning Department and Environmental Resources Management Hong Kong. 2000). Informed by the Coase Theorem, two possible effects of the legal amendment as a form of institutional change may occur. On one hand, this change may increase the transaction costs of development due to the involvement of more parties (Lai 1997a; Staley 1994). On the other hand, it may also reduce transaction costs by bringing about win-win solutions to real estate development through the gathering of better ideas, hence achieving sustainable development by transforming negative externalities into positive ones (Lai and Lorne 2006b, 2006c; Yu et al. 2000). The present study seeks to contribute to the theoretical development of communicative planning by making up for its lack of interest in the actual outcome of the development market by assessing, by both quantitative and qualitative means, the effects of the legal amendment on resource allocation in the property market. As for the potential increase in transaction costs, the null hypothesis is that the legal amendment has not altered the decisions of the Town Planning Board (TPB) and decisions by developers. To test this empirical hypothesis, S.16 planning application and S.14 consent to commence work statistics, I used the Probit Model and Univariate Time-Series Intervention analysis to respectively collect and evaluate each of them before and after the legal amendment went into effect on 10 June 2005, while following the methodologies of Lai and Ho (2001a; 2001b; 2001c; 2002a; 2002b; 2002c), Yung (2004) and Lai, et al. (2006b) along the way. IIAs for the potential contribution to innovations in development, I assessed the quality of the public comments on planning applications and TPB members during board meetings by documentary research and field observations of board meetings, respectively, over a period of six months from September 2006 to March 2007.
