Enlgish summary: European law exerts a considerable amount of influence on the legislation in the member states of the European Union. An extensive store of prohibitions also applies to the energy sector and sectors that are associated with it, to the extent that the laws of individual states alone are not able to develop a national context for energy policy. But how strong is the regulatory influence on the emergence and development of energy laws of individual states in actuality? Is it so extensive already, that it will lead to a total harmonization of energy legislation in the member states and, in this sense, might we be able to speak about a single European energy law? This present work considers the tension between the European Union and its member states with regard to energy law. The influence that supranational energy policies have on the policies of individual states is studied on the basis of an analysis of selected legislative acts that impact energy regulation (e.g., on such topics as hydrocarbons, electricity, the domestic energy market, and energy efficiency.) In this context, this study discusses in which form and to what degree European energy policies determine the legislation of individual states within a specific field and how that influence is able to obstruct national preferences and policies that reflect those preferences. On the basis of the results of this study, the key questions are followed-up conclusively, namely, whether an eventual creation of a completely harmonized and effective regulatory structure of energy policies can be established at the level of the European Union or if there are trends emerging to that effect. German description: Das Europarecht ubt einen massgeblichen Einfluss auf die Rechtsetzung in den Mitgliedstaaten der Europaischen Union aus. Auch im Energiesektor und den mit ihm verflochtenen Bereichen fuhrt ein umfangreicher Bestand an europaischen Vorgaben dazu, dass einzelstaatliches Recht kaum noch alleine in einem nationalen Kontext fortentwickelt werden kann. Doch wie stark ist der regulatorische Einfluss auf die Entstehung und Entwicklung des einzelstaatlichen Energierechts tatsachlich? Ist dieser bereits so umfassend, dass es zu einer vollstandigen Harmonisierung der Energierechtsordnungen in den Mitgliedstaaten gekommen ist und in diesem Sinne von einem europaisierten Energierecht die Rede sein kann? Die vorliegende Arbeit beschaftigt sich mit dem Spannungsverhaltnis von europaischem zu mitgliedstaatlichem Energierecht. Anhand einer Analyse ausgewahlter Energiesekundarrechtsakte, z. B. aus dem Bereich Kohlenwasserstoffe, Elektrizitat, Energiebinnenmarkt und Energieeffizienz, wird der Einfluss der supranationalen auf die einzelstaatliche Regelungsebene untersucht. In diesem Kontext wird erortert, in welcher Form und welchem Masse das europaische Energierecht die einzelstaatliche sektorale Rechtsetzung zu determinieren und ein lediglich an nationalen Praferenzen ausgerichtetes Vorgehen zu obstruieren vermag. Auf Grundlage der Ergebnisse wird schliesslich der Frage nachgegangen, ob sich durch die etwaige Schaffung vollstandig harmonisierter Regelungsstrukturen seitens der supranationalen Ebene ein einheitlich wirkendes europaisiertes Energierecht herausgebildet hat bzw. sich entsprechende Tendenzen dahingehend abzeichnen.
