In Phasen des konjunkturellen Aufschwungs eilt die Zahl der Leiharbeitnehmer dem allgemeinen Beschaftigungsaufbau zeitlich voraus. In Zeiten der Unsicherheit uber das anhaltende Wachstum nutzen Unternehmen verstarkt Leiharbeit als flexibles Instrument der Personalplanung. Wahrend eines Abschwungs bietet die Arbeitnehmeruberlassung Unternehmen die Moglichkeit, zeitnah auf Veranderungen reagieren zu konnen. Sowohl in der aktuellen Finanz- und Wirtschaftskrise als auch in Abschwungphasen der Vergangenheit geht ein Abbau der Zahl der Leiharbeitnehmer dem konjunkturellen Einbruch des Arbeitsmarktes voraus.Da Leiharbeitnehmer als Teil dieses Fruhindikators zuerst von den negativen Auswirkungen einer Rezession betroffen sind, sind sie vergleichbar hohen Risiken und Unsicherheiten ausgesetzt. Leiharbeit gilt als prekare Form atypischer Beschaftigung, da die betroffenen Arbeitnehmer oft schlechtere Arbeitsbedingungen vorfinden als Beschaftige in einem Normalarbeitsverhaltnis. Leiharbeitnehmer sind beispielsweise hoheren sozialen Belastungen ausgesetzt, da bei kurzen Einsatzzeiten keine Integration im Entleihbetrieb stattfinden kann.Die Diskussion uber die Arbeitsbedingungen der Leiharbeitnehmer ist durch die Begriffe 'equal pay' und 'equal treatment' gepragt. Durch die Schaffung gleicher Arbeitsbedingungen einschliesslich des Arbeitsentgeltes soll eine Benachteiligung von Leiharbeitnehmern im Vergleich zu den Stammarbeitnehmern im jeweiligen Entleihbetrieb vermieden werden. Dieses Ziel wollen das Europaische Parlament und der Rat mit ihrer am 21.11.2008 verabschiedeten Richtlinie 2008/104/EG uber Leiharbeit verwirklichen. Ein Blick auf die fast 30-jahrige Entstehungsgeschichte dieser Richtlinie zeigt, dass die jeweiligen nationalen Vorschriften zur Regelung der Arbeitnehmeruberlassung erheblich divergieren und aus diesem Grund lange Zeit keine Einigung auf europaischer Ebene moglich war. Auch der deutsche Gesetzgeber hat das besondere Schutzbedurfnis der Leiharbeitnehmer erkannt und als Kompensation fur die allmahliche Lockerung des Rechtes der Arbeitnehmeruberlassung einen gesetzlichen Gleichbehandlungsgrundsatz eingefuhrt.Das Ziel dieser Arbeit ist es, das deutsche Recht der Arbeitnehmeruberlassung vor dem Hintergrund der Richtlinie uber Leiharbeit auf einen moglichen Anpassungsbedarf zu analysieren
