Al ver que Puerto Rico está sumido en una crisis profunda, y que los políticos solo exploran alternativas que han fracasado en otras partes. Soy la persona más optimista que he conocido, pero no veo un mundo mejor para mis compatriotas.Es por eso que hoy escribo este ensayo. Con veinticinco años de experiencia en el mundo laboral y una amplia exposición a los debates sobre el mundo del trabajo, no encuentro respuesta a mis preguntas. ¿Por qué los derechos de los trabajadores se consideran opuestos al desarollo económico? ¿Qué motiva a los gobiernos sucesivos a manener la ilusión de que es imposible imponer responsabilidades a los patronos? La Carta de Derechos de la Constitución de Puerto Rico prohibió el discrimen por diversas razones, pero los derechos de los trabajadores están supeditados a la "batalla de la producción". Los remedios exclusivos en las situaciones en que la relación de trabajo causa daño inmediato al trabajador y que amenazan con anular su capacidad productiva-la jornada de trabajo excesiva, el despido y el accidente de trabajo -- son reliquias de fines del siglo diecinueve cuyos beneficios a los trabajadores han sido superados por los adelantos de las ciencias jurídicas y sociales. La razón de su continuación ha sido proteger al régimen industrial vigente contra reclamaciones por negligencia.En este ensayo estudio estos problemas a la luz de la historia de la legislación sobre el despido, la jornada de trabajo y los accidentes ocupacionales para encontrar la dinámica que representan.Demostraré que la clase trabajadora puertorriqueña se encuentra en un estado de indefensión frente a los intereses patronales, contrario a lo que prometía la Constitución. Al final, plantearé una alternativa viable que el propio Derecho puertorriqueño ofrece: las Corporaciones Especiales Propiedad de Trabajadores.En cada uno de los ejemplos, examinaré los orígenes de las doctrinas y su adaptación en Puerto Rico, identificaré las tendencias en cuanto a la regulación en Puerto Rico, así como las razones para las mismas, sus efectos sobre la Constitución de Puerto Rico y el mandato que ésta contiene para la Legislatura. Una vez identificadas las políticas públicas, verificaré cómo las normas, según enmendadas, han promovido los discursos subyacentes. Examinaré el historial legislativo y social de las enmiendas. Esbozaré los puntos de vista divergentes que entraron en conflicto y las reacciones de los sectores ante la entrada en vigor de la Ley. Además, examinaré las normas vigentes en otros países y los Convenios de la OIT relevantes. Veremos que el mandato constitucional es de fortalecer estas doctrinas históricas e interpretarlas a favor de los intereses de los trabajadores, pero las leyes e interpretación vigentes han privilegiado los de los patronos sobre el bienestar de los trabajadores. Éstos sólo se han podido hacer sentir a través de protestas públicas. Sin embargo, no todo está perdido, si se toman los pasos correctos: existen alternativas, que sólo requieren la voluntad política de utilizar las herramientas que ofrece la legislación vigente.
