On a question ns to damages suffered by defendant through a delay of S2 days by plain tiff in furnishing a boiler for defendant's steamboat as per contract five witnesses for defendant fixed the rental value of the boat during such days at amounts ranging from $30 to $60 per day, and some of them testified that it could have been rented readily. One of plaintiff's witnesses testified that defendant's boat might have made $1,200 during the 82 days, and another that $200 per month during such period would have been good pay, and plaintiff introduced gome testimony showing that it would have been difficult to have rented the boat. The court modified the referee's report assessing the damages at $1,640, and rendered a judgment for $820. Htid, that the referee's assessment should prevail. Appeal from superior court, Milwaukee county; George E. Sutherland, Judge. Action by Adolph Logemann and others against Henry J. Panly. From a judgment for plaintiffs, defendant appeals. Reversed.
