"The plaintiff had frequently received orders from the town council, by means of resolutions, to act as their attorney, in taking proceedings to recover all arrears of rent, to obtain possession of the corporation property, and the like; and the finance committee had often called the attention of the town council to the bills delivered in by the town-clerk, and had reported that the town-clerk had made considerable advances on account of the council. "As to the Bill, No. 1, I find that upon the facts above stated, there was no sufficient evidence of a retainer of the plaintiff by the defendants, and of right of action so as to enable the plaintiff to maintain this action in respect thereof 1842. against them. o "And as to the Bills, Nos. 2, 3, 4, 5, and 8, I find that; The Mayor, the above facts do not furnish evidence of a retainer of &c. the plaintiff by the defendants, and of right of action in respect of the matters contained in the last-mentioned bills, so as to enable the plaintiff to maintain this action, in respect of the same or either of them against the defendants. "And as to the Bills, Nos. 6, 7, 9, and 10, I find that, after allowing all just deductions and payments, there is due and owing from the defendants to the plaintiff, in respect thereof, the sum of 718/. 9. Id., which sum of 718/. 9. Id., is the debt for which I have directed the verdict to be entered as above mentioned.
