Sobre la libertad es un breve ensayo divido en cuatro capítulos, que expone de manera magistral la concepción que Mill confiere al término libertad, desde una óptica social o civil, cobijada por un principio básico de conducta: el principio de utilidad o de mayor felicidad. El principio de mayor felicidad refiere a que las acciones "son correctas en la medida en que tienden a promover la felicidad, y son incorrectas si tienden a producir lo contrario a la felicidad. Por felicidad se entiende el placer y la ausencia de dolor; por infelicidad el dolor y la falta de placer." Para Mill, la libertad es un componente necesario de la felicidad y entiende así la primera, como la facultad que tiene el individuo de actuar sobre todo aquello que no afecte ni perjudique a los demás. La sociedad puede juzgar a una persona cuando su conducta es perjudicial a los intereses de otra, pero nadie tiene por qué dar cuenta de las acciones que no menoscaban el bienestar de los demás. De este modo, Mill deja claro cómo su obra no se refiere propiamente al concepto metafísico de la libertad entendida como el libre albedrío, sino a la libertad social, entendida como la no intervención del Estado en los asuntos que atañen propiamente al individuo. Para alcanzar esta libertad es indispensable el desarrollo de la autonomía, la cual es capaz de dotar al hombre de la habilidad de discernir y hacer sus propias elecciones. La autonomía y la independencia le permiten ejercer conciencia sobre sus acciones, motivadas para obtener placer, dando cuenta de hasta dónde llegar para no afectar al otro. En la doctrina de Mill, la libertad como componente de la felicidad debe integrar las siguientes libertades, las cuales se corresponden con la denominación que da a los capítulos de su obra: El primer capítulo denominado De la libertad de pensamiento y discusión es un llamado a la expresión de nuestros propios pensamientos, incluso si estos son considerados inmorales, acompañado de la facultad de defender nuestra postura frente a otros, sin afectar a sus intereses. Defender la expresión de ideas, a través del ejercicio de la libertad de pensamiento y discusión, nos da así mismo la libertad para buscar nuestro propio bien sin hacer mal a nadie. El segundo capítulo, De la individualidad como uno de los elementos del bienestar, hace referencia a esta cualidad esencial para el libre desarrollo de la personalidad. Individualidad y autonomía están íntimamente relacionadas con la responsabilidad de la búsqueda de la propia felicidad, ya que esta se basa en la toma de decisiones, sin alterar la búsqueda de la felicidad de un tercero. De los límites de la autoridad de la sociedad frente al individuo es el tercer capítulo del ensayo de Mill, y representa un punto de inflexión en su teoría, en la medida en que expone la única razón legítima por la cual la sociedad puede imponer límites a un hombre: perjudicar los derechos de otros. Una sociedad de personas libres se concibe únicamente cuando las libertades de cada uno son respetadas y garantizadas, por lo que Mill acepta una restricción de la libertad si una acción causa daño a otro. El cuarto y último llamado Aplicaciones hace referencia a la libertad de comercio, según la cual debe ser posible llegar a acuerdos libres, bajo el principio del propio interés, tanto del que compra como del que vende.
