But, Sir, if the judgment of the House of Lords conducts us to the understanding of the nature of the aotion as entertained there, tho pleadings of the Church herself will enlighten us ns to hers, at least pmdenU lite. She, no doubt, gets a new light after judgment passes against her; hut the whele volume of her pleadings is directed and devoted to shew, that she was not bound by hue to take Mr Young on trials; because, by law, she had affixed a condition not complied with in his case. Is it asserted by any man that this was not the position of the Church in the action lately decided? I appeal to the record. Out of the month of her own Counsel it is confessed. If it is admitted that this was her position in the action, then I demand to know if giving up all claim upon the temporalities be an henest redemption of the pledge given under this position?
