La teoría jurídica se encuentra en un estado de incertidumbre: la constitucionalización del derecho, la internacionalización de los derechos humanos y la globalización de los ideales de la democracia y la libertad han desvanecido los límites tradicionales que permitían distinguir entre puntos de vista rivales, de suerte que muchos se preguntan: ¿qué es lo que realmente está en discusión?, porque parece que los filósofos, jueces y abogados hablan y discuten cosas que parecen similares pero son diferentes. Así, algunos positivistas afirman que es compatible con el positivismo la idea de que el derecho tiene algún valor moral (Raz Y MacCormick) o que el derecho requiere de un mínimo de moralidad (Hart), lo que parece negar la tesis central del positivismo, según la cual, una cosa es la existencia del derecho y otra su valor o mérito (Austin), de igual manera, en la otra orilla se hallan proclamados iusnaturalista que señalan que nunca fue una pretensión del iusnaturalismo negar la validez jurídica de una ley injusta (Finnis); es por ello que Waluchow pregunta: ¿sí el positivismo jurídico no es la teoría que defiende que incluso los sistemas jurídicos más perversos siguen siendo derecho, a pesar de su carencia de valor moral, y el iusnaturalismo aquella teoría que establece un criterio de justicia al que el derecho valido debe ajustarse para ser derecho válido, entonces qué es el positivismo jurídico y qué es lo que los iusnaturalistas han tratado de decir durante todo este tiempo? A la incertidumbre teórica se suma la perplejidad práctica. La inclusión de ideales, valores y principios de moralidad política, replantea las tesis y argumentos de las teorías jurídicas tradicionales que establecían compartimientos rígidos que permitían separar en la práctica la moral del derecho o el derecho de la política, se ha esfumado, de suerte que vivimos una especie de "derecho líquido" en el que las decisiones de un tribunal pueden incorporar argumentos estrictamente jurídicos o de moralidad política para fundamentar sus tesis y decisiones. Ante tal panorama este trabajo tiene como propósito intentar reordenar, desde una perspectiva analítico-conceptual, los diferentes enfoques teóricos sobre el derecho. Existen muchas formas de reordenar o reconstruir las teorías del derecho. Se pueden ordenar por períodos históricos (antiguo medieval, moderno o contemporánea) o por ciertos paradigmas o lugares comunes admitidos (premoderno, moderno o posmoderno) o por problemas (justicia, ciencia, método, etc.) y por otra variedad de criterios. La reconstrucción de las teorías jurídicas que se propone en este trabajo, si bien apela a las etapas históricas, mezcla este elemento con otros criterios de demarcación (conceptos, problemas, autores, teorías). Tiene, por una parte, una intención didáctica, que busca reordenar y proporcionar una mejor comprensión de la variedad de tendencias dentro de las corrientes tradicionales de la filosofía del derecho y, por otra, un propósito epistémico y metodológico, al facilitar la ubicación y la identificación de la respuesta que cada tendencia o variante dentro de la corriente sugiere frente a los diferentes problemas de la filosofía del derecho.
